Conditions of Sale

All goods remain the property of Villa & Hut group until paid in full. This includes a requirement that all cheques, deposits and credit installments must been cleared by our bank prior to any delivery or collection. Goods must be paid for in full prior to pick up or booking of your delivery. Payments can either be made in store, via direct credit to our business bank account, via pay-pal on our online store, or over the phone by credit card. Cheques must be verified as cleared by our bank prior to the shipment of goods. C.O.D to any nominated delivery company is not available. Some stock may be flat packed, pre-wrapped, or require assembly. Most items we sell are floor stock and sold in the condition presented on the shop floor.
Lay-by Conditions

A deposit of 25% must be paid to secure the lay-by, and full payment received within 8 weeks (4 weeks for sale items) with equal fortnightly payments as per schedule. Final payment must be made prior to pick up or delivery of goods. Cancellation of a lay-by will attract a 25% cancellation fee. Villa & Hut may cancel the lay-by after giving you at least 14 days written notice of a breach of the terms & conditions of the lay-by contract. If you have not made further payment within the 14 days, then it will be deemed that you have cancelled the lay-by and the standard cancellation fee will apply. Notice will be posted to your last known address, and you are responsible for notification of any change of contact details. Storage fees will apply if goods are not picked up, or delivery arranged, within the agreed time. Storage charges will apply 7 days after the agreed date at $8 per week. This includes fully paid goods, after the agreed time of delivery or pick up has elapsed. At least 48 hours notice is required prior to collecting lay-by goods.
Delivery Conditions

Villa & Hut is not a common carrier and does not offer an in-house delivery service. All deliveries are coordinated thru independent 3rd party common carriers and Villa & Hut offer a service of coordinating quotes & delivery times for you. Villa & Hut does not receive any commissions from any payments made. Villa & Hut is committed to helping you deliver your purchase as soon as possible. Please be aware however that it often takes up to 10 working days (subject to availability of stock and special orders) to enable delivery. All standard deliveries are single man - door to door services only - and subject to a fixed quote at time of purchase. If you require a 2 man delivery, you must purchase an ASSIST service. Deliveries outside a 30km radius will be charged an hourly rate from pick up to return. A minimum of 2 hours will be charged for a single man delivery and extra per hour for a 2 man delivery. Deliveries will be delivered in a 3 hour window 9-12pm and 12-3pm only. No deliveries are available on Sundays or public holidays. *Please note that All delivery fees must be paid to the nominated delivery company directly at the time of delivery.

Natural Environmental Effects

Natural weather effects such as rain, snow, hail, wind and direct sunlight can all affect the life of furniture, as can radiant heat from fireplaces and ducted heating. Items may fade, lose color, splinter or weaken if not cared for properly and failure to oil timber products, protect from extreme weather, or keep clear from radiant heat will void Limited Warranties issued by Villa & Hut as they are environmental forces. Manufactures warranty covers the deviation of any production piece that does not comply with the design standard of the product. Please read carefully and retain your warranty documents after your date of purchase.
Warranty

Faulty goods will be replaced under each items' specified warranty with the same or like product. If you do not purchase delivery at the time of purchase, then you are responsible for the return of faulty goods either to the point of purchase or to our warehouse for inspection. Pick up and delivery can be purchased separately for any returns. Every product carries a warranty which, at a minimum, is in accordance with the trade practices act of each state or territory. Natural wear & tear, fading, loss of color, rust, wind damage, glass breakage, timber bleeding, as well as stains, marks, scratches, scalding, dents or scuffing caused by usage are not covered by Villa & Hut, covered under the Manufacturer's Warranty, or covered under the Trade Practices Act if the item was sold fit for purpose and used as intended. Products sold as seconds, imperfect or shop soiled, are sold at an agreed price, respective of the condition of the goods, and 'as is'. Warranties are not available from Villa & Hut or the supplier with regards to any 'seconds' products sold. Finally, In the event of any warranty claim, please contact the store where you purchased the item, you will need to produce proof purchase and photo evidence of the claim in the first instance for assessment.
Refunds

A refund cannot be granted unless goods are returned in a saleable condition and a proof of purchase is produced. No refunds are available on 'Sale' items unless deemed defective. Please note that delivery cost to and from Villa & Hut are not refundable commodities. Refunds will only be accepted within 7 days of the purchase date. Villa & Hut's refund policy is in accordance with Section 52 of the Trade Practices Act, which does not deem an entitlement to a refund for a change of mind or failure to ensure item is used & cared for as required. To ensure security compliance ALL refunds are issued via cheque drawn in favour of the purchaser only, and requires the completion of a refund request form, including proof of purchase, identification, address for cheque to be posted, and a signature from the payee. Stores are not able to issue any refunds, and all refund request form returned to our head office does not automatically ensure the approval of a refund. Any such request may take 7-14 days to process & post.
Credit Notes & Returns

Villa & Hut are happy for you to return any item purchased from us, for any reason whatsoever, for exchange of any other item in stock, or for a credit note, for goods returned to us within 30 days of purchase. In order for us to complete this, we require proof of purchase in the form of a store receipt and/or delivery docket. All goods returned must be in the same condition as purchased, and free of any markings that could identify the item as 'used'. You will need to return goods for any exchange or credit note claim back to the original point of purchase. Please note that any delivery costs are not a claimable commodity. To ensure security compliance ALL credit notes are issued in favour of the purchaser only, and requires the completion of a credit request form, including proof of purchase. Stores are not able to issue any credit notes directly, and all credit note request forms returned to our may take 7-14 days to process & post.
